BAPS Swaminarayan Sanstha (“BAPS”) offers the mySeva Application to you, conditioned upon your acceptance of all of the terms, conditions, policies, and notices stated below. By using this application, you agree, without limitation or qualification, to be bound by, and to comply with these Terms and Conditions and any other terms, conditions, and notices as posted by BAPS. Your continued use of the application constitutes your agreement to all such terms, conditions, and notices.

Except as otherwise provided, these Terms & Conditions of Use represent the entire understanding between you and BAPS regarding your use of this application.

BAPS reserves the right, at any time, to update, revise, or remove portions of these Terms of Use or the Privacy Policy. We suggest you check periodically since your continued use of this application signifies your acceptance of any changed terms. If you are dissatisfied with these Terms or the Privacy Policy, your sole and exclusive remedy is to discontinue the use of the application.

BAPS provides this application and its services on an “as-is” basis. Online Usage:

BAPS expressly prohibits the distribution, transmission, reuse, re-post or otherwise use of the content of this application or links thereto for public, private, or commercial purposes, without the prior written permission from BAPS.

Use of this application is subject to compliance with these Terms and Conditions. BAPS reserves the right to terminate any user’s access to this application for any conduct that BAPS, in its sole discretion, believes is or may be directly or indirectly harmful to other users, to BAPS or its subsidiaries, affiliates, or business contractors, or to other third parties, or for any conduct that violates any local, state, federal, or foreign laws or regulations. BAPS further reserves the right to terminate any user’s access to this application for any reason or for no reason at all, in BAPS’ sole discretion, without prior notice, or any notice.

Any use of the above-mentioned content or the content that is related to this application, for example, training material, without the express written consent of BAPS, is strictly prohibited.

Eligibility

Users must be 18 years or older to use this application.

Applicable Law

BAPS operates this application from its offices within the state of New Jersey, the United States of America. All legal issues arising from or related to the use of this application shall be construed in accordance with, and all questions with respect thereto shall be determined by, the laws of the State of New Jersey. Any controversy or claim arising out of or relating to the use of this site shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Middlesex County, New Jersey, and judgment on the arbitration award may be entered into in any state or federal court in New Jersey having jurisdiction thereof. Any party seeking temporary or preliminary injunctive relief may do so in any state or federal court in New Jersey having jurisdiction thereof. Except as set forth above, the state and federal courts of New Jersey shall be the exclusive forum and venue to resolve disputes arising out of or relating to this site. By using this application, users consent to personal jurisdiction and venue in the state and federal courts in New Jersey with respect to all such disputes.

Termination

These Terms & Conditions of Use shall remain in force until terminated by BAPS.
